BrandTalk AI is a service operated by Global Brand View LLC ("we," "us"), a Nevada limited liability company. By creating an account or using BrandTalk AI services ("Service"), you ("Customer") agree to these Terms of Service.
We provide an AI-powered voice and chat receptionist ("Sage") trained on your business data. Sage answers calls, captures leads, books appointments, and performs related tasks on your behalf. Service tiers, included minutes, and features are described on our pricing page and may change with 30 days' notice.
You're responsible for the accuracy of information you provide, the security of your login credentials, and all activity under your account. You must be authorized to enter into this agreement on behalf of any business you represent.
You will not use BrandTalk AI for: spam or robocalls, telemarketing in violation of TCPA, debt collection without a license, deceptive practices, illegal activity, harassment, or any use prohibited by applicable law. You will not reverse-engineer, resell, or sublicense the Service without written permission.
By default, Sage discloses that callers are speaking with an AI assistant at the start of every call, in compliance with California SB 1001 and similar laws. Calls may be recorded with two-party consent disclosure where required. You're responsible for ensuring this default behavior meets the legal requirements of your specific jurisdiction; we recommend consulting your own counsel if uncertain.
Subscriptions are billed monthly or annually via Stripe. Setup fees are non-refundable except as described in our Refund Policy. Annual plans are billed monthly with a 12-month commitment in exchange for setup fee waiver and ~8% effective discount; early termination of an annual plan triggers payment of remaining commitment. Overage minutes are billed at $0.49/min unless otherwise specified.
Monthly plans may be canceled anytime through your billing dashboard. Cancellation takes effect at the end of the current billing period. Annual plans may be canceled but remain billed for the remainder of the 12-month term per Section 6.
Call recordings, transcripts, lead records, and business training data ("Customer Data") remain your property. You grant us a limited license to process Customer Data solely to operate the Service. We do not use your Customer Data to train models for other customers. You may export or delete your Customer Data at any time. See our Privacy Policy for details.
We target 99.5% uptime but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages (telephony, cloud providers, AI inference services), and force majeure may cause downtime. Our liability for downtime is capped per Section 12.
The Service depends on third parties including (but not limited to) Twilio, Stripe, OpenAI, Deepgram, ElevenLabs, Cartesia, Cloudflare, and Google. Their respective terms apply to data they handle on our behalf.
BrandTalk AI, Sage, and Global Brand View are trademarks of Global Brand View LLC. Software, prompts, and proprietary models are our intellectual property. You retain rights to your Customer Data, your business information, and any content you produce using the Service.
The Service is provided "as is." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, our aggregate liability for any claim arising under these Terms is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
You will indemnify and hold harmless Global Brand View LLC, its officers, employees, and contractors from claims arising out of your use of the Service in violation of these Terms or applicable law, including TCPA, telemarketing rules, or AI-disclosure laws.
We may update these Terms with 30 days' notice via email or in-app notification. Continued use after the effective date constitutes acceptance. If you don't agree to updated terms, your remedy is to cancel.
These Terms are governed by the laws of the State of Nevada, USA. Disputes shall be resolved exclusively in the state or federal courts located in Clark County, Nevada, except that either party may seek injunctive relief in any court of competent jurisdiction.
